New York (August 26, 2016) :\u00a0Cabbies beware: The city has the right to track everywhere you go through your G\"signage10\"PS, a federal appeals court ruled Friday.<\/h6>\n
Queens hack Hassan El-Nahal had sued the city and Taxi and Limousine Commission in 2013, charging that the TLC used his cab\u2019s GPS data against him without probable cause or a search warrant. And the feds ruled Friday that that\u2019s just fine.<\/h6>\n
The judges said it is OK because the GPS had already been installed in the car before El-Nahal drove it.<\/h6>\n
\u201cThe possibility that the government may have trespassed or physically intruded on someone\u2019s property does not necessarily entitle someone else who later acquires an interested in the that property to claim that the government trespassed or physically intruded on her property,\u201d wrote Justice Debra Ann Livingston.<\/h6>\n
The devices were installed in cabs in 2004 and used to crack down on dirty drivers a couple years later, nailing more than half of the city\u2019s nearly 22,000 cabbies for rampantly overcharging customers. El-Nahal was among those busted.<\/h6>\n
El-Nahal\u2019s lawyer said the ruling potentially creates a situation where the government could spy on anyone who drives a vehicle.<\/h6>\n
\u201cThe decision creates a potentially dangerous precedent because it would allow the government to require car makers to put GPS in cars that the government could then use to track individual drivers,\u201d said lawyer Daniel Ackman.<\/h6>\n
The city said it is happy with the ruling.<\/h6>\n
\u201cThe fact is that this technology, which enables the collection of trip data formerly captured with a pencil and a clipboard, serves a far better public purpose, supporting everything from traffic engineering improvements to market analysis,\u201d said Allan Fromberg, spokesman for the Taxi and Limousine Commission.<\/h6>\n
